13. STARTING AND FINISHING TIMES
An employee may be employed on day shift, afternoon shift or night shift on the following terms:
13.1 The ordinary hours of duty for a day shift worker shall be worked between the hours of 6.00 a.m. and 6.00 p.m., Monday to Saturday. Provided that for all hours performed on Saturday a penalty of 35% shall apply.
13.2 The ordinary hours of duty for an afternoon shift worker shall be worked between 1.00 p.m. and 1.00 a.m., Monday to Saturday. Provided however, that such employee shall be entitled to an additional loading of 17-1/2% on the appropriate weekly rate set out in clause 9 - Rates of pay. Provided further that the rate for a Saturday afternoon shift shall be 50%.
13.3 Notwithstanding the above, the ordinary hours of duty for an afternoon shift worker engaged in the reception, storing, assembly and dispatch of fresh fruit and vegetables shall be between 1.00 p.m. and 1.00 a.m., Sunday to Friday. Hours worked on Sunday to be paid at the rate of double time as provided in clause 17 - Sundays and public holidays. Hours worked from Monday to Friday shall be subject to an additional loading of 17-1/2% of the appropriate weekly rate set out in clause 9 - Rates of pay.
13.4 The ordinary hours of duty for a night shift worker shall be worked between 10.00 p.m. and 8.00 a.m. on the following day. Provided however, that such employee shall be entitled to an additional loading of 30% on the appropriate weekly rate set out in clause 9 - Rates of pay. Provided that where a night shift worker is employed on a Friday night shift the penalty shall be 65%.
13.5 The starting and finishing time for each day, of the hours making up the said 36 hours, shall be fixed in advance by the employer and shall not, after having been so fixed, be altered without seven days prior notice to the employee concerned.
