14. OVERTIME

14.1 For all work performed outside ordinary hours or in excess of eight hours (or nine hours if the 36 hours is worked over four days) on any day the rates of pay shall be time and a half for the first two hours and double time thereafter. Such double time shall continue until such overtime is completed. In computing overtime each day shall stand alone.

14.2 Subject to clause 14.3, an employer may require any employee to work reasonable overtime at overtime rates, and such employees shall work overtime in accordance with such requirements.

14.3 An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours which are unreasonable having regard to:

14.3.1 any risk to employee health and safety;

14.3.2 the employee’s personal circumstances including any family responsibilities;

14.3.3 the needs of the workplace or enterprise;

14.3.4 the notice (if any) given by the employer of the overtime and by the employee of his or her intention to refuse it; and

14.3.5 any other relevant matter.
