26. PERSONAL LEAVE FOR PERSONAL INJURY AND SICKNESS

26.1 A full-time employee shall be entitled to 61 hours leave upon commencement and thereafter upon the anniversary of each year of continuous employment.
26.2 Part-time employees shall be entitled to sick leave on a pro rata basis in accordance with provisions of clause 11.12 of this award.
26.3 Sick leave taken and approved shall be deducted from the employee’s accrued entitlement.
26.4 An employee’s unused sick leave entitlement from any year shall accrue to the following year.
26.5 Any absence on sick leave during an employee’s first six months of employment shall be withheld by PFO, until the employee completes such six months of employment. At this time, the employee shall be eligible for payment in accordance with the provisions of this clause.
26.6 An employee shall not be entitled to paid sick leave for any period in respect of which they are entitled to worker’s compensation.
26.7 The granting of sick leave shall be subject to the following conditions:
26.7.1 wherever practicable the employee shall notify the employee’s manager prior to the commencement of their shift of their inability to attend for duty and, as far as possible, the nature of the illness or injury and the estimated duration of the absence;
26.7.2 an employee shall be entitled to two single shift absences without a medical certificate in any anniversary year (provided that for any additional single shift absences, at the manager’s discretion, a medical certificate issued by a duly qualified practitioner may be requested to receive payment);
26.7.3 for any absence of two consecutive shifts or more, a medical certificate shall be required from a duly qualified practitioner to receive payment;
26.7.4 PFO may require satisfactory proof of illness for any absence on sick leave which is continuous with other forms of leave; and
26.7.5 when sick leave is approved and an employee has a current balance, the employee shall be paid their ordinary time earnings and applicable shift loadings for the rostered hours they would have worked had they not been absent.
