PART 7 - LEAVE OF ABSENCE AND PUBLIC HOLIDAY
25. ANNUAL LEAVE
25.1 All full-time employees shall, at the end of each year of continuous employment, be entitled to 152 hours of annual leave.
25.2 Part-time employees shall be entitled to annual leave on a pro rata basis in accordance with the provisions of clause 11.12 of this award.
25.3 Annual leave shall be taken by mutual agreement between PFO and the employee in varying periods of between one day and four weeks duration, provided that one such period shall be of at least two weeks duration. Where there is no agreement, annual leave shall be taken in one period of four weeks.

25.4 Annual leave shall be granted and taken by the employee within twelve months of the date of entitlement. Under no circumstances shall an employee forfeit their entitlement to such leave. At the request of an employee and with the agreement of the employer annual leave may be carried forward to a maximum of two years
25.5 When proceeding on annual leave, in addition to their ordinary time earnings, an employee shall receive a loading of 17-1/2%. However, an employee rostered in penalties hours shall receive penalties in accordance with the roster they would have worked had they not been absent on annual leave or 17-1/2%, whichever is the greater.
25.6 PFO will provide an employee with at least one month’s notice of the date from which their annual leave shall be taken or less by mutual agreement.
25.7 For periods of leave of one week or more, an employee shall receive payment for the period of absence including leave loading and any outstanding wages prior to commencing leave. Provided that at the employee’s request, PFO may:
25.7.1 withhold outstanding wages and pay them to the employee on their return to work from leave; and
25.7.2 withhold outstanding wages and payment for such leave and pay progressively using the normal pay periods.
25.8 For periods of leave of less than one week, the employee shall receive payment with their week’s wages on the normal pay day.
25.9 Where a public holiday as outlined in clause 31 to which the employee is entitled falls within a period of annual leave, the period of leave shall be increased by one day in respect of that holiday.
25.10 When the employment of an employee terminates, the employee shall be paid any accrued annual leave not taken on the basis of:
25.10.1 payment for leave entitlements accrued from previous anniversary years based upon ordinary time earnings plus 17-1/2% leave loading; and
25.10.2 payment for pro rata leave entitlements accrued from the last anniversary date, calculated on the basis of 1/12th of the ordinary time earnings for that period, excluding 17-1/2% leave loading.
25.11 Where an employee has been granted leave in advance of any entitlement and subsequently terminates their employment prior to accruing the appropriate leave, subject to State long service leave provisions, PFO may deduct monies equivalent to such leave from any payment made to the employee on termination.
