24. OVERTIME (PERMANENT EMPLOYEES)
24.1 Reasonable overtime
24.1.1 Subject to clause 24.1.2, PFO may require an employee to work reasonable overtime in accordance with the provisions of this clause.
24.1.2 An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours which are unreasonable having regard to:
24.1.2(a) any risk to employee health and safety;
24.1.2(b) the employee’s personal circumstances including any family responsibilities;
24.1.2(c) the needs of the workplace or enterprise;
24.1.2(d) the notice (if any) given by PFO of the overtime and by the employee of his or her intention to refuse it; and
24.1.2(e) any other relevant matter.
24.2 An employee shall be entitled to the payment of overtime when:
24.2.1 the employee is required to work before or after a rostered shift, (except for a part-timer who has been offered and has accepted additional hours of work in accordance with clause 11.10);
24.2.2 a full-time employee works in excess of 46 hours in a week or 152 hours in any four week cycle;
24.2.3 a part-time employee works in excess of the hours specified in clause 11.3.6;
24.2.4 an employee works in excess of five days in any week or six days in accordance with clause 21.6;
24.2.5 an employee is required to work a non-rostered shift (except for a part-timer who has been offered and has accepted additional hours of work in accordance with clause 11.10);
24.2.6 a part-time employee works in excess of 20 days in any four week cycle;
24.2.7 a full-time employee works in excess of 20 days in any four week cycle;
24.2.8 an employee works in excess of 10.5 hours (excluding meal breaks) on any shift; and
24.2.9 an employee works in excess of nine hours (excluding meal breaks) on any shift, except on two shifts in any week when an employee may be rostered to work up to a maximum of 10.5 hours (exclusive of meal breaks), without payment of overtime.
24.3 Should an employee recommence work without a ten hour break, as per clause 21.13, they shall be paid at overtime rates until a minimum ten hour break is provided.
24.4 Should an employee be required to work overtime on a day they are not rostered to work they will be provided with a minimum three hour engagement.
24.5 Authorised overtime shall be paid at the following rates:
24.5.1 Monday to Sunday: first two hours at time and half, double time thereafter;
24.5.2 public holiday: double time and a half;
24.5.3 overtime: shall be calculated to the nearest fifteen minutes; and
24.5.4 each shift shall stand alone (i.e. overtime shall be treated on a daily or shift basis and shall be non-cumulative).
24.6 An employee may elect to take time off in lieu of overtime provided:
24.6.1 the time off shall be calculated at the overtime equivalent;
24.6.2 the employee shall be entitled to a fresh choice of payment or time off on each occasion overtime is worked; and
24.6.3 time off must be taken within one calendar month of the working of the overtime, or shall be paid out.
