23.1 An annual leave loading of 17.5 per cent is payable upon and in addition to the employee’s ordinary weekly rate prescribed under Table 1 of Appendix A - Monetary rates for the period of the annual leave taken, when the employee takes such leave. Allowances, penalty rates, overtime or any other payments prescribed under this award are not to be taken into account in calculating the amount on which the loading is payable.
23.2 No loading is payable to an employee who takes an annual holiday wholly or partly in advance during the first year of employment. If the employment of such an employee continues until the day when he or she would have become entitled under the Annual Holidays Act 1944 (NSW) to an annual holiday, the loading is then paid in respect of the period of such holiday, After the first year of employment the employee may be paid a wage rate loaded to include the annual leave loading instead of receiving the loading when the leave is taken.
