23. REST PERIODS, MINIMUM BASE TURNAROUND AND DUTY FREE TIME
23.1 Rest Periods during flight duty
A flight attendant must not work more than 6 hours, from the commencement of an operating flight duty period without commencing a rest break of 20 minutes, such rest break to be included in the duty period. For every additional 4 hours of operating flight duty following the first 6 hours he or she must commence a further rest break of 20 minutes, such rest break to be included in the duty period.
23.2 Rest Periods following flight duty
A flight attendant is entitled to a rest period following each flight duty period.
23.2.1 Minimum rest period
23.2.1(a) Except as provided in 23.2.2, the minimum rest period following a flight duty period will be the sum of the planned flight time of that duty period plus any planned flight time between 2000 and 0800 local time calculated from the initial departure port of that duty period.
23.2.1(b) The minimum rest period provided in 23.2.1(a) must not be less than 12 hours nor more than 20 hours.
23.2.1(c) In unplanned circumstances, an operating and/or deadheading crew may, by majority decision of those affected by a reduction, elect to reduce the rest period to 10 hours.
23.2.1(d) In unplanned circumstances, an operating and/or deadheading crew, may by majority decision of those affected by a reduction, elect to reduce the rest period to not less than nine hours either, where that nine hours embraces the hours between 2200 and 0600 local time or, where that nine hours embraces the hours between 2300 and 0700 local time and the subsequent flight duty period is not planned at more than six hours.
23.2.2 Minimum rest period during extended flight duty periods
23.2.2(a) If the immediately preceding operating flight duty period is planned at more than 14 hours; or, the immediately preceding deadheading flight duty period is planned at more than 24 hours the minimum rest period following such duty period must be 36 hours or 2 local nights whichever is the lesser.
23.2.2(b) In unplanned circumstances an operating or deadheading crew may, by majority decision of those affected by a reduction, elect to reduce the rest period to not less than eighteen hours or one local night whichever is the lesser.
23.2.3 A flight attendant is entitled to one rest period of 46 hours within the first 3 rest periods and one such rest period within each 2 succeeding rest periods following the first 3 rest periods constituted in a pattern.
23.2.3(a) The Company may vary as required the occurrence of such rest period within the first 3 rest periods and within each 2 succeeding rest periods constituted in a pattern.
23.2.3(b) In unplanned circumstances the Company may reduce such rest period to not less than the minimum applicable to the immediately preceding flight duty period as specified in 23.2.1 and 23.2.2.
23.2.4 The Company and the Association may agree to vary as appropriate the planned length and/or occurrence of any rest period as to all or any flight attendants.
23.2.5 Despite 23.2.3, if a flight attendant has deadheaded in accordance with 19.4.2, and subsequent to taking his or her rest period in accordance with 23.2.2 he or she must be governed by the subsequent rest period sequence of the crew on the pattern which he or she joins.
23.3 Minimum base turnaround time
23.3.1 A flight attendant will not be required to carry out any duty related to his or her employment without his or her agreement during minimum base turnaround time except as provided in the following subclause.
23.3.2 A flight attendant is entitled to minimum base turnaround time, which may include designated duty free days, on arrival at his or her base on completion of each pattern except if:
23.3.2(a) the flight attendant's base is considered to be a transit within a planned or scheduled pattern; or
23.3.2(b) the flight attendant is awarded Open Time duty which conflicts with the minimum base turnaround time associated with his or her previous pattern and/or where the minimum base turnaround time or minimum duty free time associated with the awarded Open Time conflicts with his or her next duty.
23.3.3 Minimum base turnaround time at a flight attendant's base on completion of a pattern is as follows:
23.3.3(a) For a pattern of one day away from base in a time equal to the rest period specified in 23.2.2.
23.3.3(b) For a pattern of 2 to 4 days away from base - a time equal to the rest period specified in 23.2.2 relevant to the last flight duty period within the pattern; or one local night whichever is the greater.
23.3.3(c) For a pattern of 5 to 8 days away from base or a pattern where the accrued duty hour credits exceed 25 - two local nights.
23.3.3(d) For a pattern of 9 to 12 days away from base or a pattern where the accrued duty hour credits exceed 50 - three local nights.
23.3.3(e) For a pattern of more than 12 days away from base or a pattern where the accrued duty hour credits exceed 75 - four local nights.
23.3.3(f) If a flight attendant exceeds 125 duty hour credits in 28 consecutive days, he or she is entitled to additional minimum base turnaround time on completion of the pattern causing the excess as follows:
23.3.4 The parties may agree to vary minimum base turnaround for specific patterns.
23.3.5 If a flight attendant is not able to complete the minimum base turnaround time to which he or she is entitled before the planned report time of his or her next pattern or duty, the Company must remove him or her from the pattern or duty unless he or she advises the Company before the normal closure of open time or on return to base whichever is the later that he or she will fly such pattern or perform the duty.
23.4 Duty free time at base
23.4.1 Eighteen designated duty free days will be planned in each bid period for full time flight attendants. Such days for a Reserve Line Holder will be planned in groups comprising 2 periods of 3 days and 6 periods of 2 days distributed through the bid period. Where a flight attendant is a reserve line holder for part of a bid period and/or is on approved leave for part of a bid period, designated duty free days will be allocated on a pro rata basis for that part of the bid period. Designated duty free days in a bid period may be moved by agreement between the flight attendant and the Company.
23.4.2 Where a flight attendant is a bid line holder for two consecutive bid periods standing alone (i.e. 112 days) he or she is entitled to 48 periods of 24 hours free of duty as described in the following subclause.
23.4.2(a) Duty free periods will be measured from the time the flight attendant is released from duty until he or she commences his or her next duty. Duty free periods of 24 consecutive hours or any period in excess of 24 consecutive hours but not exceeding 35 hours 59 minutes will be treated as one 24 hour period. Duty free periods of 36 consecutive hours but not exceeding 47 hours 59 minutes will be treated as one and a half 24 hour periods, etc.
23.4.3 Single day refresher training undertaken by a flight attendant will be treated as duty free periods.
23.4.4 Available days allocated to a Flying Line Holder or Reserve Line Holder on which no duty has been performed will be considered duty free periods but will not be considered designated duty free days.
23.4.5 Infringement of designated duty free days - Flying Line Holders
A Flying Line Holder may have his or her designated duty free days infringed under the following circumstances:
23.4.5(a) when he or she returns to his or her base from a pattern later than planned and the later return conflicts with designated duty free day(s);
23.4.5(b) when a ground duty extends beyond midnight and conflicts with a designated duty free day;
23.4.5(c) when the Company is unable to assign a ground duty on other than a designated duty free day;
23.4.5(d) when a Flying Line Holder is assigned Open time or Standby Duty and this duty conflicts with designated duty free days.
23.4.5(e) when the Flying Line Holder is assigned a pattern or duty as an assignable time available or pay protected flight attendant and such pattern or duty conflicts with designated duty free day(s).
23.4.5(f) when the Flying Line Holder is awarded a pattern or duty and such pattern or duty conflicts with designated duty free days. In such circumstances the infringed designated duty free day(s) will not be re-designated.
23.4.6 In the circumstances outlined in 23.4.5(a), 23.4.5(b), 23.4.5(c) and 23.4.5(d), the infringed designated duty free day(s) will be redesignated to be taken immediately after the pattern or duty causing the infringement without interfering with the Flying Line Holder's planned patterns or duties.
23.4.7 In the circumstances outlined in 24.4.5 (e) the infringed designated duty free day(s) may be redesignated after or before the pattern or duty causing the infringement.
23.4.8 When a bid period ends prior to the Flying Line Holder receiving his or her entitlement to designated duty free days the shortfall will be redesignated into the next bid period.
23.4.9 A Flying Line Holder who is not an assignable or pay protected flight attendant will be entitled to consider that all days of availability are duty free periods except where he/she has been awarded or assigned a duty on one or more of such available days.
23.4.10 Infringement of designated duty free days - Reserve Line Holders
A Reserve Line Holder may have his or her designated duty free days infringed under the following circumstances:
23.4.10(a) when he or she is assigned a pattern or duty which conflicts with designated duty free day(s);
23.4.10(b) when ground duty extends beyond midnight and conflicts with a designated duty free day;
23.4.10(c) when the Company is unable to assign a ground duty on other than a designated duty free day.
23.4.11 When duty free days are infringed as outlined in 23.4.10:
23.4.11(a) the infringed designated duty free day(s) will be redesignated to be taken immediately after the pattern or duty causing the infringement; or
23.4.11(b) the flight attendant may at his or her option retain the designated duty free day(s) not directly affected by the duty causing the infringement and have only the day(s) affected by the infringement redesignated. A flight attendant will not be required to perform another duty on such redesignated duty free day(s).
23.4.12 When a bid period ends prior to a Reserve Line Holder receiving his or her entitlement to designated duty free day(s) the shortfall will be redesignated into the next bid period.
23.4.13 The granting of movement of designated duty free days to create up to five consecutive designated duty free days will be subject to operational requirements.
23.4.14 A flight attendant will not be assigned to any duty during an available day or designated duty free day with less than 8 hours notice without his or her consent unless he/she has omitted to contact the Company as required.
