22.1 Accrual
22.1.1 The minimum guaranteed hours for a full time flight attendant in a 56 day bid period will be 149 duty hour credits.
22.1.2 Except as provided elsewhere in this award and for the purpose of calculating wages, a flight attendant, other than a flight attendant under initial training, or part-time flight attendant , will accrue duty hour credits in accordance with this clause on the basis of:
22.1.2(a) the number of duty hour credits accrued in a bid period; or
22.1.2(b) pay for 149 duty hour credits in a bid period, whichever is the greater.
22.1.3 A flight attendant's duty hour credits for a bid period will be the sum of the duty hour credits accrued in that bid period.
22.2 Pattern duty hour credits
22.2.1 In calculating duty hour credits for a pattern, the greater of 22.2.2 and 22.2.3 will apply.
22.2.2 Flight duty credits
22.2.2(a) For each planned hour of flight duty a flight attendant will accrue one duty hour credit, prorated for time less than one hour.
22.2.2(b) Duty hour credits calculated in accordance with sub 22.2.2(a) will be reduced by 30 minutes for each hour of each planned transit of 6 hours or more, within a flight duty period, for all such time in excess of 90 minutes prorated for time less than one hour.
22.2.3 Away from base credit
A flight attendant will accrue a credit of one hour for each four hours, prorated for time less than one hour, of the elapsed planned time away from base of a pattern.
22.3 Approved paid leave
22.3.1 A Reserve Line Holder employed as a full time flight attendant will accrue duty hour credits at the rate of 149 duty hour credits divided by 56 for each day of approved paid leave other than sick leave.
22.3.1(a) The credits will not be given in the case of approved paid leave, nor will sick leave be debited, once the flight attendant has accrued 149 duty hour credits. A Reserve Line Holder will accrue duty hour credits at the rate of 149 duty hour credits divided by 38 for each day of approved paid sick leave.
22.3.2 A Flying Line Holder employed as a full time flight attendant will accrue duty hour credits at the rate of 187 duty hour credits divided by 56 for each day of approved paid leave, other than sick leave. A Flying Line Holder will accrue duty hour credits at the rate of 187 duty hour credits divided by 38 for each day of approved paid sick leave.
22.3.3 If a Flying Line Holder is granted approved paid leave after the awarding of his or her flying line, duty hour credits (determined in accordance with 22.3.2):
except that an assignable time available flight attendant will be given such duty hour credits to increase his or her projected duty hour credits up to 149 duty hour credits after having first offset any pay protected hours to which he or she is entitled. Duty hour credits given for annual leave or long service leave must offset only those pay protected hours resulting from such leave.
22.4 Standby
A flight attendant who performs Standby duty will accrue a duty hour credit of 10 minutes for each hour of standby, prorated for time less than one hour.
22.5 Ground duties
22.5.1 A flight attendant who performs a Ground Duty will accrue a duty hour credit of 30 minutes for each hour of Ground Duty prorated for time less than one hour. The duty hour credits will not be given if additional Ground Duty is undertaken because of the flight attendant's failure to maintain or reach the required standard of proficiency as set by the Company or if the flight attendant requests additional training.
22.5.2 Duty hour credits for single day refresher training Ground Duty will be given for the purpose of offsetting any pay protection to which a flight attendant may be entitled and will not be included in a flight attendant's projected duty hour credits.
22.5.3 Duty hour credits for other than single day refresher training Ground Duty will first be given for the purposes of offsetting any pay protection to which a flight attendant may be entitled and will be included in a flight attendant's projected duty hour credits.
22.6 Ground duty in excess of eight hours
22.6.1 When a flight attendant's actual ground duty period exceeds eight hours the flight attendant will receive an additional payment of 30 minutes for each hour that his or her actual duty period exceeds eight hours prorated for time less than one hour at his or her applicable rate of pay per duty hour credit.
22.6.2 In addition to the payment in 22.6.1, when a flight attendant's actual ground duty period exceeds ten hours the flight attendant will receive an additional payment of 30 minutes for each hour that his or her actual duty period exceeds ten hours prorated.
22.7 Approved courses
If a flight attendant attends a Company approved internal or external course appropriate to the classification structure as a trainee he or she will accrue duty hour credits at the following rate of each day of the course - The flying line holders divisor applicable to the flight attendants category during the period of the course divided by 38.
22.8 Cancelled or removed duty after reporting
22.8.1 If a flight attendant reports for duty at base and subsequently that duty is cancelled or the flight attendant is removed from that duty:
22.8.1(a) the flight attendant must be credited with three duty hour credits or duty hour credits equivalent to the actual time on duty whichever is the greater; or
22.8.1(b) if the flight attendant accepts another duty departing on the same day, the flight attendant must be credited with duty hour credits for the period between the original report time and the report time for the new duty.
22.8.2 This clause will not apply if a flight attendant is removed from a duty for lack of proficiency or failure to meet or fulfil a recognised responsibility.
22.9 Flight Attendant not entitled to duty hour credits
22.9.1 A flight attendant who:
22.9.1(a) cannot be usefully employed because of the fault of the flight attendant; or
22.9.1(b) fails to meet or fulfil a recognised responsibility; or
22.9.1(c) fails to provide a medical certificate as required by the Company; or
22.9.1(d) proceeds on unpaid leave for any day
will have his or her duty hour credits and pay entitlements reduced by 149 duty hour credits divided by 56 for each such day if a Reserve Line Holder and/or 187 duty hour credits divided by 56 for each such day if a Flying Line Holder. The Company will notify the flight attendant in writing of the reason(s) for such reduction.
22.9.2 A Flying Line Holder or Reserve Line Holder who, with Company approval, is removed from a pattern or a portion of a pattern at his or her own request will not be entitled to the accrual of duty hour credits for that pattern or that portion of the pattern which was removed.
22.10 Duty Hour credit recalculation
22.10.1 If a flight attendant's pattern is changed, either prior to the Company required reporting time at the flight attendant's base for that pattern or during the performance of that pattern, the duty hour credits for that changed pattern will be recalculated as if the pattern was planned and will be treated as follows:
22.10.1(a) If the recalculated duty hour credits exceed the duty hour credits of the original pattern, the additional duty hour credits will be considered to be planned, both for the purposes of pay and bid period limitations.
22.10.1(b) If an overprojection results from the recalculation of a pattern as prescribed in 22.10.1(a), the conditions contained in clause 24 – Pay Protection will apply.
22.10.1(c) If the recalculated duty hour credits are less than the duty hour credits of the original pattern the conditions contained in clause 24 – Pay Protection will apply.
22.10.2 A flight attendant's pattern will be considered to be changed if:
22.10.2(a) there is a change of routing of the pattern; and/or
22.10.2(b) there is a change of flight/trip number within the pattern; and/or
22.10.2(c) there is a change such that the actual transit within a flight duty period is less than six hours and where such transit had been planned, and duty hour credits calculated, as if the transit were six hours or more; and/or
22.10.2(d) there is a change only in the time and/or day of arrival at the flight attendant's base at the completion of a pattern in which case only away from base credits will be recalculated.
22.10.3 Pay entitlements determined under 16.2, 17.7, 22.6 are not duty hour credits and do not affect flight duty period limitations, minimum rest period entitlements or bid period limitations.
