13. OCCUPATIONAL SUPERANNUATION

Note: The Superannuation Legislation Amendment (Choice of Superannuation Funds) Act 2005 provides that individual employees generally have the opportunity to choose their own superannuation funds. For further information see the AIRC guidance note — Choice of Superannuation Funds and Award Provisions

13.1 Employees will be entitled to superannuation payments and benefits and employers will make payments to approved superannuation funds in accordance with the Superannuation Guarantee (Administration) Act 1992 and related legislation.

13.2 Ordinary time earnings” for the purposes of the Superannuation Guarantee (Administration) Act 1992 and related legislation will mean the actual ordinary rate of pay the employee receives for ordinary hours of work including shift loading and leading hand, in charge or supervisory allowances where applicable. The term includes any over award payment as well as casual rates received for ordinary hours worked. Ordinary time earnings will not include overtime, disability allowances, commission, bonuses, lump sum payments made as a consequence of the termination of employment, annual leave loading, penalty rates for public holiday work, fares and travelling time allowances or any other extraneous payments of a like nature.
