20.1 All wages must be paid weekly in addition to any commission, bonus or premium to which the employee is entitled. The payment must be made on the same day of each week, which will not be a Friday, a Saturday or a Sunday except as detailed in this clause, and will be made up to and including at least the third day preceding the day of payment; however, in a week where an award holiday falls on the day in which wages are usually paid, payment thereof will be made not later than the working day immediately preceding the award holiday. Other arrangements regarding payment may be made by agreement between the employer and the union.
20.2 Despite the above requirements
20.2.1 Overtime
Overtime must be paid not later than one week from the second day succeeding the day on which it was earned however where an employee is paid fortnightly under 20.2.7 then overtime worked in the second week of a pay period may be paid in the following pay period.
20.2.2 Payment on termination
Where employment is terminated an employee will be paid as soon as possible all ordinary wages due and will be paid all overtime and other moneys due within seven days of the date of the termination of employment.
20.2.3 Reimbursement
In the event of an employer not paying the overtime and other moneys due at the time on which he/she has undertaken to pay then the employer will reimburse the employee all expenses he/she has incurred in attending to collect the amounts due to him/her.
20.2.4 Casual and part-time employees
Casual employees and part-time employees may elect to be paid on a Friday, Saturday or Sunday, should they so wish.
20.2.5 Waiting time
Where an employee is required by an employer to wait beyond the ordinary ceasing time of the employee for payment of ordinary wages, or when an employee is terminated and is required by the employer to wait for payment of ordinary wages after the period of the termination for a period of more than fifteen minutes, he/she will be paid his/her ordinary wages for the period during which he/she is so required to wait.
20.2.6 Electronic funds transfer
Wages may be paid by electronic funds transfer, however where wages are paid by electronic funds transfer additional costs associated with the introduction and operation of electronic funds transfer will be paid by the employer.
20.2.7 Fortnightly payment
Wages may be paid fortnightly however the employee is to be paid no later than the third day of the second week of the pay period.
20.2.8 Alternative arrangement
However by agreement with an employee or employees an employer may implement an alternative arrangement. The agreement must be in writing, signed by the employee/s and the employer.
