21. ALLOWANCES

21.1 Photographic, modelling or mannequin work

A shop assistant who is engaged in photographic or other modelling or mannequin work must be paid the sum of $40.50 each week or $8.10 each day for the time engaged on this work in addition to the appropriate rate prescribed by clause 18 - Wage rates, of this award.

21.2 First hand

Where there are four or more assistants in an order room apart from the department, one assistant must be classed as first hand and must be paid $16.40 each week in addition to the senior weekly rate set out in clause 18 - Wage rates, of this award.

21.4.1 Freezer and dairy

Employees whose primary function is the handling or loading of goods into or out of freezer rooms or freezer cabinets (i.e. a room or cabinet with an inside temperature falling below 0o Celsius) must be paid a disability allowance of $7.85 each week, in the case of full-time employees, and a proportionate amount in the case of casual and part-time employees.

21.4.2 Employees whose primary function is working in a public dairy room or backfilling a dairy cabinet must be paid a disability allowance of $11.80 each week, in the case of full-time employees, and a proportionate amount in the case of casual and part-time employees.

21.4.3 Employees whose primary function is backfilling in a freezer room (i.e. a room with an inside temperature falling below 0o Celsius) must be paid a disability allowance of $15.70 each week, in the case of full-time employees, and a proportionate amount in the case of casual and part-time employees.

21.4.4 Protective clothing reimbursement - freezer room

Where an employee is either:

the employer must reimburse the employee for the cost of purchasing and laundering suitable protective clothing. The provisions of this clause do not apply where the suitable clothing is supplied to the employee and laundered at the employer’s expense.

21.4.4(a) Suitable protective clothing for employees whose primary function is the handling or loading of goods into or out of freezer rooms or freezer cabinets means:

21.4.4(c) Suitable protective clothing for employees whose primary function is backfilling in a freezer room means:

21.4.4(d) Suitable protective clothing for employees whose primary function is the handling or loading of goods into or out of freezer cabinets means:

21.4.4(e) Suitable protective clothing for employees whose primary function is the handling or loading of goods into or out of dairy cabinets means:

21.4.4(f) Suitable protective clothing must be provided upon request to employees who are required to load or unload trucks or customers’ vehicles.

21.4.4(g) Clothing provided by the employer in pursuance of 21.6 and 21.4.4(f) of this Part must be maintained by the employer at his/her expense in good repair and in a clean and hygienic condition.

21.5 Meal allowance

21.5.1 Employees employed before 14 September 1987

21.5.1(a) An employee employed by the employer before 14 September 1987, who works after 6.30 p.m. on any day must be paid on the day $11.10 as a meal allowance. However casual employees who begin work after 4.30 p.m. will not be entitled to the meal allowance.

21.5.1(b) However by agreement with an employee or employees an employer may provide a suitable meal in lieu of the payment of the meal allowance. The agreement must be in writing, signed by the employee or employees with a copy noted by the employer supplied to the employee or employees.

21.5.2 Employees employed after 14 September 1987

21.5.2(a) An employee, employed after 14 September 1987 who works overtime after 6.30 p.m. on any day must be paid on the day $10.80 as a meal allowance.

21.5.2(b) However by agreement with an employee or employees an employer may provide a suitable meal in lieu of the payment of the meal allowance. The agreement must be in writing, signed by the employee or employees with a copy noted by the employer supplied to the employee or employees.

21.5.3 Work on a Sunday

21.5.3(a) An employee who is required to work overtime on any Sunday beyond 1.00 p.m. must be paid $10.80 as a meal allowance and if required to work beyond 6.00 p.m. on a Sunday, the employee must be paid a further sum of $10.80.

21.5.3(b) However by agreement with an employee or employees an employer may provide a suitable meal in lieu of the payment of the meal allowance. The agreement must be in writing, signed by the employee or employees with a copy noted by the employer supplied to the employee or employees.

21.5.4 Exception

However, if the shop closes at 7.00 p.m. or earlier on the late trading night, the meal allowance will not be payable.

21.6 Uniform allowance

21.6.1 Where an employee is required to wear a uniform, overalls, set dress or uniform dress, then the cost of clothing and laundering must be reimbursed by the employer. This shall not apply where the required clothing and laundering is provided by the employer at the employer’s expense.

21.6.2 Where the employer refuses, fails or neglects to launder the clothing, or where it is agreed that the employee will launder the clothing, the following laundering allowance must be paid to the employee:

21.6.2(a) Full-time employees must be paid $9.20 per week if any articles require ironing, and $5.50 per week if none of the articles require ironing.

21.6.2(b) Part-time and casual employees must be paid $3.15 per article which requires ironing, with a maximum payment of $9.20 per week, and $1.90 per article which does not require ironing, with a maximum payment of $5.50 per week

21.7 Vehicle

21.7.1 An employee required to provide:

21.7.1(a) a bicycle must be paid $10.80 each week;

21.7.1(b) a motorcycle must be paid $32.30 each week;

21.7.1(c) a motor vehicle up to and including 2000cc must be paid $112.80 each week;

21.7.1(d) a motor vehicle over 2000cc must be paid $134.40 each week;

21.7.2 However, where an employee other than a part-time or casual retail merchandiser occasionally uses his/her vehicle by agreement with his/her employer, in the employer’s business, he/she must be paid an allowance for each kilometre so travelled as follows:

21.7.3 A part-time or casual retail merchandiser must be paid for the use of his/her motor vehicle an amount of 61.2 cents each kilometre travelled in connection with his/her employment with no standing charge in this paragraph to apply.

21.7.4 If the employer provides a vehicle he/she must pay the whole cost of the upkeep, registration, insurance and running expenses.

21.8 First aid

An employee who holds an appropriate first aid qualification and is appointed by the employer to perform first aid duty must be paid $7.90 each week in addition to the appropriate rate prescribed by clause 18 - Wage rates, of this award.

21.9 Protective clothing reimbursement

Where it is agreed the work performed by an employee is of a dirty, wet or obnoxious nature requiring suitable protective clothing, the employer must reimburse the employee for the costs incurred in purchasing the suitable protective clothing and any necessary laundering cost incurred by the employee. This shall not apply where suitable protective clothing is provided and laundered at the employer’s cost.
