9. AWARD FACILITATIVE PROVISIONS

9.1 This award contains facilitative provisions, which provide that the standard approach in an award provision may be departed from by agreement between TransAdelaide and the unions and/or an employee - or the majority of employees - in the worksite, department or section concerned.

9.2 Facilitative provisions are not to be used as a device to avoid award obligations nor should they result in unfairness to an employee or employees covered by this award.

9.3 The facilitative provisions are contained in the following clauses:
