11. DISPUTE RESOLUTION PROCEDURES
11.1 Without prejudice to either party and except where a bona fide safety issue is involved, work will continue in accordance with this award existing between the parties while matters in dispute are negotiated in good faith and in accordance with the procedures contained hereunder:
11.1.1 provided any grievance, claim or dispute relates to a local matter only and its settlement will not have a repercussive effect at other locations, the matter which is of concern will be discussed between the accredited local job representative and/or the employee(s) concerned, and the immediate supervisor who will make every effort to settle the matter including reference to management for assistance where necessary;
11.1.2 if the matter is not settled by this means it will be referred to the union delegate or official, who will consult with the appropriate representative of management who will, within 24 hours (or a longer or shorter period as may be agreed), arrange a meeting of the parties to discuss the matter;
11.1.3 in instances where the matter is not settled, the Business Unit Manager and State or Branch union officers will be notified and a meeting on the matter will be arranged within two working days, to be attended by union official(s) and the union job representative(s) concerned and representatives of TransAdelaide;
11.1.4 if the dispute cannot be resolved at this level and the above procedures have been exhausted, it may then be submitted, within a period of five working days, to the Australian Industrial Relations Commission for resolution;
11.1.5 nothing contained in this procedure will prevent the National/Federal/General Secretary of the union or the deputy and the General Manager of TransAdelaide or the nominated TransAdelaide or employee representatives, from entering into negotiations at any level in respect of matters in dispute should such action appear necessary in order to achieve resolution. Advice will be conveyed by the one party to the other prior to this course of action being taken;
11.1.6 in the event of a party failing to observe these procedures, the other party may take such steps as are open to it to resolve the matter;
11.1.7 Statewide or Nationwide stoppages directed by the United Trades and Labour Council of South Australia or the ACTU are not considered disputes to which this dispute settlement procedure applies;
11.1.8 in the event of a dispute arising, the above procedure will be observed and work will continue in accordance with the immediate past practice prior to the commencement of the dispute.
