25. OVERTIME

25.1 Definition

Overtime for a full-time employee will be all time worked in excess of ordinary hours on any one day or in excess of ordinary hours per fortnight, whichever is to the employee’s advantage.

25.2 Requirement to work reasonable overtime

TransAdelaide may require any employee to work reasonable overtime at overtime rates and the employee must work overtime as required. An employee will not work overtime unless authorised by TransAdelaide.

25.3 Overtime payment – shift workers

Except as provided for in 23.5, for all time worked in excess of or outside the ordinary working hours prescribed by this award or on a shift other than a rostered shift, a shift worker will be paid at the rate of time and a half for the first three hours and double time thereafter, except in each case when the time is worked:

25.4 Overtime payment – day workers

Except as provided for in 25.6 and 25.7 for all work done outside ordinary hours the rates of pay will be time and a half for the first three hours and double time thereafter until the completion of the overtime work.

25.5 Saturday work

25.5.1 A day worker required to work overtime on a Saturday will be paid for a minimum of three hours work on each turn of duty.

25.5.2 A day worker will be paid at the rate of time and one half for the first three hours and double time thereafter.

25.6 Sunday work

25.6.1 A day worker, required to work overtime on a Sunday will be paid for a minimum of three hours work on each turn of duty.

25.6.2 A day worker will be paid at the rate of double time for work done on a Sunday.

25.7 Public holiday work

A day worker required to work overtime on a public holiday will be paid at the rate of double time and a half.

25.8 Limit of overtime payments

25.8.1 Employees classified Salaried Employee Level 6 or Salaried Employee Level 7 will be paid overtime at the Salaried Employee Level 5 rate of pay.

25.8.2 Employees classified Salaried Employee Level 8 and above will not be entitled to overtime payment.

25.9 Call back

An employee recalled to work overtime after leaving TransAdelaide (whether notified before or after leaving worksite, department or section concerned) is to be paid for a minimum of three hours work at the appropriate overtime penalty rate. The employee will be entitled to be absent for eight consecutive hours without deduction of pay before commencing a succeeding shift.

25.10 Rest breaks

25.10.1 An employee working overtime will be allowed a crib time of twenty minutes without deduction of pay after each four hours of overtime worked if the employee continues work after such crib time.

25.10.2 Unless the period of overtime is less than one and a half hours an employee, before starting overtime after working ordinary hours, will be allowed a meal break of twenty minutes which will be paid for at ordinary rates. TransAdelaide and an employee may agree to any variation of this provision to meet the circumstances of the work in hand provided that TransAdelaide will not be required to make payment in respect of any time allowed in excess of twenty minutes.
