For the purposes of this clause:
14.1.1 Afternoon shift means any shift finishing after 6.00 p.m. and at or before midnight.
14.1.2 Continuous work means work carried on with consecutive shifts of employees throughout the 24 hours of at least six days without interruption except due to breakdowns or meal breaks or due to unavoidable causes beyond the control of the Employer.
14.1.3 Night shift means any shift finishing subsequent to midnight and at or before 8.00 a.m.
14.1.4 Rostered shift means a shift for which the employee concerned has had at least 48 hours notice.
The ordinary hours of work shall not exceed ten in any one day, provided that by arrangement between the employer, the union and the majority of employees concerned, ordinary hours not exceeding twelve in any day may be worked subject to the employer and employees being guided by the ACTU Code of Conduct on Twelve Hour Shifts.
14.3.1 Shift workers whilst on afternoon or night shifts shall be paid 15% more than the ordinary rate for such shifts.
14.3.2 Shift workers whose roster does not provide for a regular day shift in the cycle shall be paid 30% more than the ordinary rate for their shifts.
14.3.3 Shift workers who work on an afternoon or night shift that does not continue for at least three successive afternoons or nights shall be paid for at overtime rates.
14.4 Shift allowance and overtime
When calculating overtime for shift workers, the base rate of pay will be used and the shift allowance will not be applied.
Shift rosters shall be prepared specifying the commencing and finishing time of ordinary working hours of the respective shifts.
14.6 The time of commencing and finishing shifts and method of working shifts may be varied by agreement between the Employer and a Union representative to suit the circumstances of the workplace or in the absence of agreement by seven days’ notice of alterations given by the Employer to the employees.
