PART 5 - HOURS OF WORK, BREAKS AND OVERTIME, WEEKEND WORK
21. HOURS OF WORK
21.1 Hours of work may be rostered to cover any hours of the day and days of the week.
21.2 The ordinary hours of work for employees other than part-time employees or casual employees shall not exceed an average of:
21.2.1 thirty seven and one half hours per week; or
21.2.2 forty hours per week,
depending on the practice at particular sites on the date this award becomes operational.
21.3 The ordinary hours of work shall not exceed ten in any one day, provided that by arrangement between the employer, the union and the majority of employees concerned, ordinary hours not exceeding twelve in any day may be worked subject to the employer and employees being guided by the ACTU Code of Conduct on Twelve Hour Shifts.
21.4 Where the employees at a particular site currently work an average of 37-1/2 ordinary hours per week and a majority of employees at that site decide they wish to work an average of 40 ordinary hours per week, then the average number of hours worked by employees at that site shall increase to 40 hours per week. Any such change to the average number of hours per week shall be processed in accordance with clause 8 - Grievance and dispute settlement procedures and clause 9 - Consultation and enterprise flexibility, of this award.
21.5 The ordinary hours of work shall be worked between 6.00 a.m. and 6.00 p.m. Provided that the actual ordinary hours of work shall be determined by agreement between the employer and the majority of employees at the site or work section or sections concerned. The ordinary hours of work may be extended to 5.00 a.m. and 7.00 p.m., where a majority of employees at a particular site or work section or sections seek to access the broader span of hours to accommodate a specific site or work section need.
21.6 The ordinary hours worked shall be exclusive of the time taken for a meal break.
21.7 Where necessary to accommodate the requirements of the Employer’s customers, alternative patterns of work may be arranged as follows:
21.7.1 A rostered work cycle may be established and that cycle must repeat on a regular basis.
21.7.2 The total ordinary hours of work in the cycle shall be 37-1/2, or 40, (as the case may be) multiplied by the number of weeks (working and non-working) in the cycle. Each cycle shall not exceed eight weeks.
21.7.3 The number of ordinary hours worked in a day may be up to twelve provided that the number of days in a cycle on which ordinary time may be worked shall not exceed five days multiplied by the number of weeks in the cycle.
21.7.4 The number of ordinary hours worked in a day shall be the regular rostered hours of the day and overtime shall be paid for any time in excess of the regular rostered hours of the day.
21.7.5 Where Saturdays and Sundays are worked in the cycle the regularly rostered hours shall be paid at the rate of time plus one half and hours worked in excess of the regularly rostered hours shall be paid at the rate of double time.
21.8 The Employer will determine and establish rosters relevant to workplace and such rosters shall be posted at a place accessible to all employees.
