28. PAYMENT OF WAGES

28.1 All wages and overtime shall be paid in the employers time on a day to be determined by the employer but not later than Thursday of each week. The day, on being fixed, shall not be altered more than once in three months.
28.2 Wages may be paid in cash (enclosed in an envelope), and by agreement between the employer and the employee by cheque or electronic funds transfer to a bank or building society account in the employee’s name.
28.3 All earnings, including overtime, shall be paid within two days of the expiration of the pay week in which they accrue.

28.4 If an employer fails to make payment to any employee as prescribed on pay day he/she shall pay to each such employee $16.48 for each and every day or part thereof during which such default continues, unless he/she satisfactorily shows that such failure is due to some act on the part of the employee or to circumstances not under his/her control and which he/she could not reasonably have foreseen and which he/she took reasonable steps to avoid or overcome.

28.5 Notwithstanding anything contained herein, an employer shall pay to an employee who leaves or is dismissed all moneys due to him forthwith failing which he/she shall pay to the employee the sum of $16.48 for each day or part thereof during which such default continues.
