30.1 Meal break - day work
Employees on day work must receive an unpaid meal break of between 30 minutes and one hour. An employee must not be required to work for more than five hours without a meal break. If a meal break is not so allowed, all time worked after the commencement time of the regular meal break until the meal break is allowed must be paid for at the rate of double time. Provided that this clause may be varied by agreement between Virgin Tech and a majority of employees in accordance with the facilitative provision.
30.2 Meal break - shift work
30.2.1 Shift workers on continuous work must be allowed a meal break of at least twenty minutes per shift to be counted as time worked.
30.2.2 Shift workers not on continuous work must be allowed a meal break of between 30 minutes and one hour at a time chosen by Virgin Tech. The meal break must not be counted as time worked.
30.2.3 The meal break must be taken no later than five hours after commencing an ordinary shift.
30.2.4 If a meal break is not so allowed, all time worked after the commencement time of the regular meal break until the meal break is allowed must be paid for at the rate of double time.
30.3 Rest breaks
A shift worker must be given rest break of not more than ten minutes each shift counted as time worked.
30.4 Meal breaks/meal money
30.4.1 If an employee is required for overtime duty in excess of two hours before the normal starting time or in excess of two hours after the usual finishing time and the employee was not notified the day before:
30.4.1(a) the employee must be given a meal break of twenty minutes paid at the appropriate overtime rate of pay;
30.4.1(b) the employee must be given a further meal break of 30 minutes at the completion of each further four hour period of overtime worked paid at the appropriate overtime rate of pay;

30.4.1(c) the employee must be paid a meal allowance of $9.05 or provided with a suitable meal by Virgin Tech.
30.4.2 These meal breaks must not to be used in the calculation of overtime hours.

30.4.3 An employee who is working on a recall or on a day off must be paid a meal allowance of $9.05 if the employee performs four hours actual work. This applies for each four hour period worked or the employee must be provided with a suitable meal by Virgin Tech or be paid.
