13. DISPUTE SETTLING PROCEDURE

13.1 In the event of a dispute arising in the workplace the procedure to resolve the matter will be as follows:

13.1.1 The employee and the employee's supervisor meeting and conferring on the matter. The employee may appoint another person to act on their behalf including a shop steward or delegate of their union. Where the shop steward or delegate is involved, he or she must be allowed the necessary time during working hours to interview the employee(s) and the supervisor.

13.1.2 If the matter is not resolved at this meeting, the parties must arrange for further discussions between the employee and his or her nominated representative, if any, and more senior levels of management. The shop steward or delegate must be allowed, at a place designated by the Company, a reasonable period of time during working hours to interview the duly accredited union officials of the union to which they belong.

13.2 If the matter is still not resolved, the matter must be discussed as follows:

13.2.1 between the representative of the Company and the Branch Secretary of the Union or other employee representative;

13.2.2 if the matter is not resolved it must be discussed between the representative of the Company and the federal body of the Union, if appropriate, or other employee representative.

13.3 If the matter cannot be resolved it may be referred to the Commission.

13.4 While the parties attempt to resolve the matter work must continue in accordance with this award and their contract of employment unless an employee has a reasonable concern about imminent risk to safety or health. In this case, an employee must not unreasonably fail to comply with a direction of the Company to perform other available work, whether at the same or another workplace that was safe and appropriate for the employee to perform.
