21. OVERTIME

21.1 Where an employee with the employer's authorisation works more than his/her stipulated ordinary hours of duty, the employee will be compensated with time off in lieu for such overtime at the following rate:

21.2 An employee who works overtime is entitled to have a break of at least 10 consecutive hours plus reasonable travelling time between the cessation of one period of duty and the commencement of the next period of duty.

21.3 The employee is entitled to take time off in lieu in the next pay period following accrual, otherwise it is to be taken at a mutually agreed time as soon as practicable after it has been accrued.

21.3.1 If on the anniversary of an employee's appointment the employee has accumulated time off in lieu in excess of the equivalent to 76 ordinary hours, the employer must ensure the employee takes sufficient time off in lieu to reduce accumulated hours to at or below 76 ordinary hours.

21.3.2 If at the expiry of 6 months after the anniversary date an employee holds accumulated time off in lieu credits in excess of 76 ordinary hours, the employer must pay the employee for those hours in excess.

21.4 An employer by agreement may make a payment to an employee for extra hours worked. Payment is to be at the employee's ordinary hourly rate, with the hours calculated in accordance with clause 21.1 above.
