21. PERFORMANCE OF HIGHER DUTIES

21.1 An employee will be eligible for the payment of higher duties allowance when he/she temporarily performs duties at a higher classification level.

21.2 If an employee is required to perform duties at a higher classification level for at least half a day, he/she will be regarded as performing those duties for the full day and paid accordingly.

21.3 Performance of duties at the higher classification level will be deemed to be performance of higher duties at the higher classification level for the purpose of subclause 21.4.

21.4 When an employee temporarily performs the duties of a classification for which the conditions of service differ from the conditions of service of his/her usual classification then he/she will be subject to the conditions of the classification at which he/she is acting at the time.

21.5 When an employee does not perform the full duties at a higher classification level, he/she may be paid in respect of the performance of those duties an allowance of such amount as Airservices Australia determines. If a dispute arises over the application of this clause the matter will be referred to the Australian Industrial Relations Commission in accordance with the Dispute Settling provision, where the appropriate allowance will be determined by a member of the Commission.

21.6 An allowance granted under this clause will be regarded as salary for the purposes of calculating travelling allowance, overtime and penalty payments.

21.7 When an employee is grated leave with pay while receiving higher duties allowance, he/she will continue to receive the allowance as if he/she would have continued to perform the duties but for the grant of leave, provided that where the leave is half pay leave, the payment of the allowance will be made on a pro rata basis.
