22. LEAVE LOADING (ANNUAL LEAVE — ADDITIONAL PAYMENT)
22.1 An employee will be entitled to payment of the greater of the following 22.1.1 or 22.1.2 in addition to any other sum payable for annual leave which has accrued.
22.1.1 A sum equal to 17-1/2 % of the salary of the employee at 1 January of the year in which the leave accrued for the period of the leave accrued.
22.1.2 Penalty payment to which an employee is entitled for shift, Saturday or Sunday duty not in excess of prescribed weekly hours which he/she would have performed had he/she not been on annual leave.
22.2 The annual leave bonus has been commuted as follows:
22.2.1 The value of the leave bonus will be calculated as at the rate applicable on 1 January 1993 and added to the annual salary.
22.2.2 Following commencement of this clause the amount included in salary in lieu of the annual leave bonus will be immediately considered as salary for all purposes including superannuation contributions and overtime.
22.3 Penalty payments will cease to be payable to shift workers during annual leave.
22.4 Employees who are receiving shift penalties in lieu of leave bonus under existing conditions will not be disadvantaged by the application of these provisions.
