PART 6 - HOURS OF WORK, OVERTIME, EMERGENCY DUTY, RESTRICTION DUTY AND SHIFT WORK 

26. HOURS OF WORK

26.1 Ordinary Hours of Work

26.1.1 Ordinary hours of work is the period on any one day when an employee is ordinarily required to attend work by the employer.

26.1.2 The employer will determine the method of recording attendance.

26.1.3 Employees’ ordinary hours of work differ depending upon:

26.1.3(a) an employee’s job classification,

26.1.3(b) whether the employee is a shiftworker,

26.1.3(c) whether flextime arrangements as outlined in 26.5 apply.

26.1.4 An employee’s ordinary hours of work are to be worked continuously on any day, except for meal breaks.

26.1.5 Shift workers are employees who work rostered shift work which includes hours outside the span relevant to the employee’s classification.

26.1.6 An employee must have a break of at least 30 minutes after 5 hours of ordinary work.

26.2 Classifications on 36 3/4 hour week

26.2.1 The ordinary hours of work for all employees in the following categories of staff must not exceed an average of 36 3/4 per week.

Administrative Service Officer
Air Traffic Controller (non shift worker)
Airways Data Systems Officer (non shift worker)
Cadet
Legal Officer
Principal Research Officer
Professional Officer
Research Officer
Senior Officer
Senior Officer (technical)
Senior Professional Officer
Senior Research Officer
Technical Officer
Trainee Technical Officer

26.2.2 The bandwidth is from 8.00am to 6.00pm inclusive on any day Monday to Friday - except as set out in 26.5 - Flextime.

26.3 Classification on 38 Hour Week

26.3.1 The ordinary hours of work for all employees in the following categories of staff must not exceed an average of 38 hours per week:

Aviation Firefighter
Aviation Fire Officer
General Service Officer
Public Affairs Officer
Senior Public Affairs Officer
Senior Stores Supervisor
Stores Supervisor

26.3.2 The bandwidth for day workers who work a 38 hour week is from 7.00am and 5.00pm on any one day, Monday to Friday, except as set out in 26.5 – Flextime.

26.3.3 A local arrangement for a 38 hour week employee whose rostered day off has been changed by the employer, an alternative day may be agreed in order to provide an alternative paid day off at the earliest date agreed by the employee and the employer.

26.4 Classifications on 36 Hour Week

26.4.1 The ordinary hours of work for all employees in the following categories of staff who are shiftworkers must not exceed an average of 36 hours per week or 72 hours a fortnight:

Airways Data Systems Officer
Air Traffic Controller
Flight Service Officer.

26.4.2 The ordinary fortnightly total of 72 hours is made up of an average of 70 hours of rostered shifts and up to an additional twelve minutes per shift where “hand-over” duties are required.

26.4.3 The total rostered ordinary hours of duty of air traffic controllers engaged on shift work will not exceed 72 hours per fortnight on average. The ordinary fortnightly total of 72 hours is made up of 72 hours of rostered shift and up to an additional 12 minutes per shift where required for hand-over duties. The ordinary hours of duty and rostered hours will be averaged over the acquittal period specified for the roster concerned.

26.4.4 The length of normal shift may be within the range of six to ten hours. Within teams the length of individual shifts will be between six and eight hours, including eight hours unless otherwise agreed.

26.5 Flextime

26.5.1 Flextime is a system which allows an employee to reach an agreement with the employer on flexible working hours subject to the provisions of this clause.

26.5.2 An agreement to introduce flextime in a particular workplace can be reached between the employer and a majority of employees. Once majority agreement has been reached the operation of the flextime system may be agreed between the employer and an individual employee.

26.5.3 Flextime will operate in Airservices unless the employer:

26.5.3(a) considers it necessary, because of essential work requirements, for an employee or group of employees in a workplace to revert to the hours of a standard day for a period, or

26.5.3(b) removes an employee from flextime for a specified period because that employee has failed to comply with the provisions of flextime.

26.5.4 Flextime will not apply to:

26.5.4(a) employees who are required to work according to a shift roster;

26.5.4(b) employees who work a 38 hour week and who are entitled to a rostered day off in a regular cycle;

26.5.4(c) employees whose classification has a minimum salary rate equivalent to or greater than the Senior Officer C Classification in this Award, unless they work flextime by agreement with the employer; or

26.5.4(d) regular part-time employees.

26.5.5 The bandwidth available to staff to work flextime is 8.00am to 6.00pm, Monday to Friday, unless otherwise agreed between the employer and the majority of employees at the workplace.

26.5.6 A meal break must be taken within the period 12 noon and 2.00pm, unless otherwise agreed between the employer and an individual employee.

26.5.7 The time of commencement and cessation of duty will be subject to agreement between the supervisor and the employee. An employee’s attendance outside the hours of the standard day but within the span of hours will be subject to the availability of work and the approval of the employee’s supervisor.

26.6 Rostered Days Off

26.6.1 For those employees who are entitled to a rostered day off in a regular cycle, a system of rostered days off, which may include the banking of such days, may be established by agreement between the employer and majority of affected employees.

26.6.2 A supervisor and employee may agree to alternative rostered day(s) off (including taking the time as part days).

26.7 Two Block Leave Roster

Aviation Rescue and Firefighting Service employees at 24 hour Units who work a 10/14 roster system based on a 42 hour work cycle will take the excess hours in a 104 hour block twice per year in lieu of rostered days off.
