27. OVERTIME

27.1 The employer may call an employee for duty any time the employee is needed.

27.2 An employee must be paid at overtime rates for any work done outside of his or her prescribed hours of duty. The exception is where the duty is emergency duty which is set out in Clause 28 - Emergency duty.

27.3 Employees on flextime are entitled to overtime as set out in 26.5.

27.4 Employees are not paid overtime rates for travel time.

27.5 When the employee works overtime after a break from ordinary duty which is not a meal break, he or she will be paid for 4 hours or the actual hours worked, whichever is the greater.

27.6 The overtime rate payable to an employee depends on the time at which the overtime is worked.

27.6.1 Monday to Saturday

27.6.2 Sunday

27.6.3 Public Holidays

27.7 Except with the approval of Airservices, employees whose classification has a minimum salary less than the Senior Officer Grade C classification in this award will not be eligible for overtime payment.

27.8 Time off in lieu of payment of overtime (TOIL)

An employee may agree to be given time off in lieu of payment of overtime equivalent to the hours worked at the overtime rate or as a mixture of payment and time in lieu to the same value. Airservices will not pay in lieu of TOIL on cessation, where it is accrued but not taken.
