36. PUBLIC HOLIDAYS

36.1 An employee is entitled to holidays on the following days:

36.1.1 New Years Day, Good Friday, Easter Saturday, Easter Monday, Christmas Day and Boxing Day; and

36.1.2 the following days, as prescribed in the relevant States, Territories or localities: Australia Day, Anzac Day, Queen's Birthday, Eight Hours’ Day, or Labour Day; and

36.1.3 Such other days as is generally observed in a locality as a substitute for any of the said days.

36.2 Employees are entitled to one additional holiday. The additional holiday will normally be granted by Airservices Australia in conjunction with Christmas/New Year holidays.

36.3 Employees will be entitled to any other gazetted holidays observed in the particular locality in which they are working at the time.

36.4 An employee on approved leave without pay either immediately before or after a public holiday, receives payment for the public holiday.

36.5 When Christmas Day is a Saturday or Sunday, a holiday in lieu must be observed on 27 December.

36.6 When Boxing Day is a Saturday or Sunday a holiday in lieu must be observed on 28 December.

36.7 When New Years Day or Australia Day is a Saturday or Sunday, a holiday in lieu must be observed on the next Monday.

36.8 Airservices, with the agreement of the unions which are parties to this award, may substitute another day for any prescribed in this clause:

36.8.1 Airservices and its employees may agree to substitute another day for any prescribed in this clause. For this purpose, the consent of the majority of affected employees will constitute agreement.

36.8.2 An agreement pursuant to 36.8.1 must be recorded in writing and be available to every affected employee.

36.8.3 The unions which are parties to this award must be informed of an agreement pursuant to 36.8.1 and may within seven days refuse to accept it. The unions must not unreasonably refuse to accept the agreement.

36.8.4 If a union, pursuant to 36.8.3 refuses to accept an agreement, the parties will seek to resolve their differences to the satisfaction of the employer, the employees and the unions.

36.8.5 If no resolution is achieved pursuant to 36.8.4, the employer may apply to the Commission for approval of the agreement reached with their employees. This application must be made fourteen or more days before the prescribed holiday. After giving the employer and the unions an opportunity to be heard, the Commission will determine the application.
