21.1 Overtime
21.1.1 All time worked in excess of, or outside the ordinary hours of work, shall be paid for at the rate of time and a half for the first two hours and double time thereafter. In computing overtime each days work shall stand alone.
21.1.2 An employee required to work overtime on a Saturday or Sunday shall be paid for a minimum of four hours at the appropriate rate. Provided that where an employee is required to attend for a domestic service requiring immediate attention, a minimum of two hours at the appropriate rate shall apply. If such a domestic service extends for more than two hours, a minimum payment of four hours at the appropriate rate shall be paid.
21.1.3 An employee required to work overtime which is not continuous with ordinary hours, except as provided in 21.1.2 hereof, shall be paid a minimum of four hours at the appropriate rates.
21.1.4 An employee required to work during their normal meal break shall be paid at overtime rates until the meal break is taken.
21.2 Rest period after overtime
21.2.1 When overtime work is necessary, it shall wherever reasonably practicable, be so arranged that employees have at least ten consecutive hours off duty between the work of successive days.
21.2.2 An employee (other than a casual employee) who works so much overtime between the termination of the employee’s ordinary work on one day and the commencement of the employee’s ordinary work on the next day that the employee has not at least ten consecutive hours off duty between those times shall, subject to this subclause, be released after completion of such overtime until the employee has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
21.2.3 If on the instructions of the employer such an employee resumes or continues work without having had such ten consecutive hours off duty the employee shall be paid at double rates until the employee is released from duty for such period, and the employee shall then be entitled to be absent until the employee has ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
21.3 Call back
21.3.1 An employee recalled to work overtime after leaving the employer's business premises (whether notified before or after leaving the premises) shall be paid for a minimum of four hours' work provided that, except in cases of unforeseen circumstances arising, the employee shall not be required to work the full four hours, if the job the employee was recalled to perform is completed within a shorter period.
21.3.2 Overtime worked in the circumstances specified in this subclause shall not be regarded as overtime for the purpose of 21.1 hereof, when the actual time worked is less than three hours on such recall or on each of such recalls.
21.4 Crib time
21.4.1 An employee working overtime shall be allowed a crib time of twenty minutes without deduction of pay after each four hours of overtime worked if the employee continues work after such crib time.
21.4.2 Provided that where a day worker on a five-day week is required to work overtime on a Saturday the first prescribed crib time shall, if occurring between 10.00 a.m. and 1.00 p.m. be paid at ordinary rates.
21.4.3 Unless the period of overtime is less than one and a half hours an employee before starting overtime after working ordinary hours shall be allowed a meal break of twenty minutes which shall be paid for at ordinary rates. An employer and employee may agree to any variation of this provision to meet the circumstances of the work in hand provided that the employer shall not be required to make any payment in respect of any time allowed in excess of twenty minutes.
21.5 Weekend work
21.5.1 For all ordinary hours worked between midnight Friday and midnight Saturday the rate of pay shall be time and one half of the ordinary hourly rate for each ordinary hour worked.
21.5.2 For all ordinary hours worked between midnight Saturday and midnight Sunday the rate of pay shall be twice the ordinary hourly rate for each ordinary hour worked.
21.5.3 The ordinary hourly rate is the employees appropriate weekly classification rate divided by 38.
21.5.4 The rates prescribed in this clause shall be in substitution for and not complementary to the rates prescribed in clause 22 - Shift work, of this award.
21.6 Work on public holidays
21.6.1 An employee required to work on any of the public holidays set out in clause 27 - Public holidays, of this award, shall be paid at the rate of double time and one half.
21.6.2 Employees required to work on any of the public holidays shall be paid for a minimum of four hours' work. Provided that where an employee is required to attend for a domestic service requiring immediate attention a minimum payment of two hours at the appropriate rate shall apply. If a domestic service extends for more than two hours a minimum payment of four hours at the appropriate rate shall be made.
