PART 5 - RATES OF PAY AND RELATED MATTERS
16. CLASSIFICATIONS AND RATES OF PAY
16.1.1 Subject to the exceptions and exemptions prescribed in this clause, an adult employee in a classification or class of work specified in the table set out in this clause (other than a apprentice or an employee in respect of whom a provision under Section 123 of Workplace Relations Act 1996 is in force) will be paid at the respective award wage rate per week assigned to that classification or class or work set out in the following tables.
16.1.2 The outline of classification structure will be read in conjunction with the definitions set out in 16.1.6.
16.1.3 Further, the relationship between the previous classification structure and the current classification structure is set out in Part 8.
16.1.4 Procedures for reclassification are prescribed by Part 8.
16.1.5 The following adult employees are not entitled to receive the award rate of pay set out in the table in 16.1.7.

16.1.7(a) The rates of pay in 16.1.7 reflect in their entirety the rates for equivalent classifications in the Australian Public Service Award 1998. Upon settlement of the order in matter number C90111 of 1998, these rates will be amended so as to replicate the rates in the Australian Public Service Award as varied by that order.

16.1.8 The rates of pay in this award include the arbitrated safety net adjustment payable under the Safety Net Review – Wages June 2005 decision [PR002005]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement is not required.
16.1.9 Increases made under previous National Wage Case Principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.
