14.1 Except as otherwise provided in this award, all time worked outside the times fixed for normal starting and finishing work shall be overtime.
14.2 Those employees whose classifications are prescribed in 6.2 and recognised as outdoor workers, shall be paid for all overtime worked as follows:
14.2.1 Time and a half for the first two hours worked and double time thereafter, provided that double time shall be paid for all overtime worked between 11.00 p.m. and the employee's ordinary starting time.
14.2.2 Except where otherwise specified by this award, payment shall be at the rate of double time for all work performed between 11.00 p.m. Friday and ordinary starting time on the following Monday. A minimum daily payment of three hours shall apply.
14.2.3 Where employees are required to work on their rostered day off a day in lieu shall be granted on the following Friday or such other day of the following week as may be mutually agreed, provided that if a day in lieu cannot be granted because of work commitments, the employee shall be paid the appropriate overtime rate for the day so worked.
14.2.4 Overtime shall apply to part-time employees where time worked exceeds 7.6 hours per day.
14.2.5 For work directed to be done during normal meal hours and thereafter until a meal break is allowed, time and a half rates shall be paid. Provided that an employee so directed shall, after performing such duties, be afforded a full meal break.
14.2.6 Tip assistants - in addition, for work on public holidays, shall be paid time and a half plus one day's leave in lieu.
14.3 Those employees whose classifications are prescribed in 6.2 and are recognised as indoor employees shall be paid for all overtime worked as follows:
14.3.1 Time and a half for the first three hours worked and double time thereafter, each day's work stands alone.
14.3.2 Except where otherwise specified by this award, payment shall be at the rate of double time for all work performed between 11.00 p.m. Friday and ordinary starting time on the following Monday. A minimum daily payment of three hours shall apply.
14.3.3 Overtime shall apply to part-time employees where time worked exceeds 7.5 hours per day.
14.3.4 Time off in lieu of payment of overtime may be arranged by mutual agreement at ordinary rates of pay.
14.3.5 Records of time accrued and taken off in lieu of overtime shall be maintained by each department manager.
14.4 Subclause 14.3 shall not apply to casual employees, employees engaged in seven day per week operations, or museum staff on field work, or where an employee has entered into a Special Arrangements Employment Agreement.
14.5 This clause applies to all employees.
14.5.1 Where overtime work is necessary, it shall, wherever reasonably practicable, be so arranged that employees have at least ten consecutive hours off duty between the work of successive days.
14.5.2 Employees (other than casual employees) working so much overtime between the termination of ordinary work on one day and the commencement of ordinary work the next day that they have not had at least ten consecutive hours off duty between those times shall, subject to this subclause, be released after completion of such overtime until they have had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
14.5.3 If on the instruction of the employer an employee resumes or continues work without having had such ten consecutive hours off duty, then payment will be at double rates until released from duty. The employee shall then be entitled to be absent for ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
14.5.4 Employees required to work on a public holiday between what would be the normal starting time and the normal finishing time on an ordinary working day, shall be paid at one and a half times the ordinary prescribed rate for all time worked; and if required to work on a holiday outside such ordinary working times, shall be paid at two and a half times the ordinary prescribed rate for all time worked; such payments to be in addition to the normal wages for the day with a minimum payment of three hours.
14.6 Compensatory leave
14.6.1 For positions where working hours are determined by the operating hours of a facility, compensatory leave may be provided by mutual consent in lieu of overtime and public holidays worked.
14.6.2 The compensatory leave shall comprise the same number of ordinary working hours as the actual hours of work for which the leave is given. Compensatory leave may be added to recreational leave if mutually convenient.
