17.1 All employees shall, after completion of twelve months continuous service, be entitled to the equivalent of four weeks annual leave (based on their normal working hours arrangement). This leave shall be exclusive of public/bank holidays and will be paid for at the normal weekly rates.
[17.2 substituted by PR970637 ppc 24Mar06]
17.2 Leave shall be taken within two years of becoming due, unless mutually arranged otherwise. In cases where employees and the employer agree, leave shall be taken at different times of the year. Leave shall not be unreasonably withheld. An employee may elect, with the consent of the employer, to take annual leave in single day periods or part of a single day not exceeding a total of 10 days in any calendar year at a time or times agreed between them.
17.3 Employees will have their entitlements adjusted on their anniversary date.
17.4 After one month's service pro rata accruals of leave may be taken by mutual agreement.
17.5 Employees whose services are dispensed with or terminated shall be paid pro rata annual leave in respect of each completed month of service.
17.6 Any approved leave shall not break the continuity of service, but if leave without pay, at the employee's request, has been approved, the annual leave accrual shall be based on the actual time worked during the year.
17.7 Payment of annual leave shall be at the normal weekly pay the employee would have received had leave not been taken. Payments made pursuant to Clause 9 - Relieving and higher duties shall be taken into account.
17.8 Payment shall not be made or taken in lieu of annual leave, unless mutually agreed.
17.9 Accumulated leave shall be exclusive of intervening holidays, sick and accident leave, absence on workers' compensation, or any approved leave with or without pay, subject to the conditions of 17.6.
17.10 Thirteen additional consecutive days of annual leave shall apply to the following classifications:
17.10.1 Streetsweepers, garbage workers, drivers of mechanical streetsweepers, water-flusher drivers, tip assistants and water-pump operators.
17.10.2 This extra leave recognises the unusual hours these employees work and applies if these duties are done continuously for twelve months. Pro rata entitlement shall be made to relief operators.
