22. SHIFT WORK

22.1 Definitions

The definitions pertaining to various shift work arrangements are set out in clause 4 - Definitions.

22.2 Ordinary hours of work

22.2.1 The ordinary hours of work for shift workers will average 38 per week over the duration of the shift cycle.

22.2.2 Subject to the conditions specified below, shift workers shall work at such times as the Company may require.

22.2.2(a) A normal shift will consist of a maximum of twelve hours, inclusive of one, twenty minute paid crib break. Such ordinary hours are to be worked continuously except for this crib break.

22.2.2(b) Subject to 22.2.2(c), the taking of crib breaks will be mutually determined by the Company and the clerical employees concerned and may be staggered to meet business needs.

22.2.2(c) A shift worker, subject to operational needs, will not be required to work more than the following hours continuously without the twenty minute paid crib break specified above:

22.2.2(c)(i) five hours in respect of shifts of up to and including ten ordinary hours duration; or

22.2.2(c)(ii) six hours in respect of shifts of more than ten ordinary hours duration.

22.2.2(d) A shift worker will not be required to work more than six shifts in any week.

22.3 One shift in 24 hours

Except at regular changeover of shifts, a clerical employee shall not be required to work more than one shift in each 24 hour period.

22.4 Rosters

Shift rosters shall specify the commencing and finishing times of ordinary working hours of the respective shifts.

22.5 Variation by agreement

22.5.1 The method of working shifts may in any case be varied as to specified clerical employees by agreement between the Company and the majority of employees affected to suit business needs.

22.5.2 The time of commencing and finishing shifts once having been determined may be varied by agreement between the Company and the majority of employees affected to suit the circumstances of the establishment or, in the absence of agreement, by seven days notice in writing of alteration given by the Company. to the employees involved.

22.6 Daylight saving

22.6.1 Where by reason of the legislation of the State of Victoria summer time is prescribed as being in advance of standard time, the length of any shift:

22.6.1(a) commencing before the time prescribed by the relevant legislation for the commencement of a summer time period; or

22.6.1(b) commencing on or before the time prescribed by such legislation for the termination of a summer time period;

shall be deemed to be the number of hours represented by the difference between the time recorded by the clock at the beginning of the shift and the time so recorded at the end of the shift. The time of the clock in each case is to be set to the time fixed pursuant to the relevant State legislation.

22.6.2 In this clause the expressions standard time and summer time will bear the same meaning as are prescribed by the relevant State legislation.

22.7 Shift work - juniors

No employee aged less than eighteen years shall be employed on shift work.
