21. ROSTERING PRINCIPLES - PERMANENT EMPLOYEES

21.1 All rosters for full-time employees shall provide for 152 hours over any four week cycle.

21.2 All rosters for part-time employees shall provide for an agreed number of hours over any four week cycle in accordance with clause 11.

21.3 The minimum engagement an employee may be rostered to work on any day shall be:

21.3.1 five hours for full-time employees; and

21.3.2 three hours for part-time employees.

21.4 The maximum engagement an employee may be rostered on any day shall be 10.5 hours (exclusive of meal breaks) subject to clause 21.10.

21.5 An employee shall not be rostered to commence work on more than one occasion on any day.

21.6 Rostered hours shall be worked on not more than five days in each week, provided that rostered hours may be worked on six days in one week if in the following week rostered hours are worked on not more than four days.

21.7 An employee may be rostered to a maximum of six consecutive days in any fortnight.

21.8 A part-time employee may be rostered to a maximum of 20 days in any four week cycle.

21.9 A full-time employee may be rostered to work to a maximum 20 days in any four week cycle.

21.10 An employee may be rostered to work a maximum of nine hours (exclusive of meal breaks) on any shift. Provided that on two shifts in any week, an employee may be rostered to work up to a maximum of 10.5 hours (exclusive of meal breaks).

21.11 The maximum hours an employee may be rostered to work in any week shall be 46 for a full-time employee and 38 hours for a part-time employee.

21.12 Permanent employees must be rostered in such a way that they shall receive at least two consecutive days off each fortnight.

21.13 There shall be a minimum break of ten hours between an employee’s finishing time on one shift (including overtime) and commencing time on the next shift. Where an employee does not receive such a break between shifts they shall be paid in accordance with clause 24.3.

21.14 Due to unexpected operational requirements, an employee’s roster for a given day may be changed by mutual agreement with the employee at the commencement of their shift. Any permanent roster change must be provided to the employee in writing with a minimum seven days notice. Should the employee disagree with any permanent roster change, the employee shall be provided with a minimum 14 days written notice in lieu of seven, during which time there shall be discussions aimed at resolving the matter in accordance with clause 9 - Grievance procedures, as provided in this award.

21.15 Subject to clause 21.14, employees shall be provided with rosters on a permanent basis.

21.16 An employee’s roster may not be changed with the intent of avoiding payment of penalties or loadings, or other benefits applicable. Should such circumstances arise, the employee shall be entitled to such penalty, loading or benefit, as if the employee’s roster had not been changed.

21.17 All employees may be required to work on a Sunday.

21.18 An employee (other than a volunteer) may be rostered to work a maximum of three Sundays in any four week cycle, and shall be rostered off on at least one Sunday on a three day break incorporating a Saturday and a Sunday.

21.19 Any employee transferred from casual to permanent employment shall be paid at the stipulated award rate in accordance with clause 14 - Classification, rates of pay and superannuation of this award from the date of transfer.
