PART 6 - HOURS OF WORK, SHIFT WORK, MEAL BREAKS AND OVERTIME
19. HOURS OF WORK
19.1 The ordinary hours of work of a full time employee are an average of 38 hours per week.
19.2 The ordinary hours of work will be averaged over a cycle of 28 days.
19.3 The ordinary hours of work will be arranged so as to provide an additional day off in each four week cycle.
19.4 Employees engaged as shift workers may work up to a maximum of 12 ordinary hours on any day.
19.5 Day work
19.5.1 The ordinary hours of work prescribed herein will be worked continuously (exclusive of meal breaks), between 7.00 a.m. and 6.00 p.m. Monday to Friday.
19.5.2 The hours of work for an employee or employees may be altered by the Company within the spread of hours prescribed above after giving seven day’s notice.
19.5.3 The Company and an employee or the majority of employees in the section or sections concerned may agree to extend the hours of work outside the spread of hours detailed in clause 19.5.1.
19.5.4 Subject to this clause, the Company and an employee or the majority of employees concerned may agree on the following:
19.5.4(a) alternative methods of arranging ordinary hours over a work cycle;
19.5.4(b) arranging ordinary hours of work above and below eight per day to a maximum of 12;
19.5.4(c) alternative methods to substitute and accrue 20th days.
19.6 Twelve hour shifts
By agreement between the Company and the majority of employees in the affected section or part of the affected section concerned, 12 hour days or shifts may be introduced subject to:
19.6.1 Proper health monitoring procedures being introduced;
19.6.2 Suitable roster arrangements being made;
19.6.3 Proper supervision being provided;
19.6.4 Adequate breaks being provided;
19.6.5 An adequate trial or review process being implemented through the consultative process.
19.7 Shift work arrangements
19.7.1 Definitions
For the purposes of this clause the following definitions shall apply:
19.7.1(a) Early morning shift
Any shift commencing between midnight and 6.59 a.m.
19.7.1(b) Afternoon shift
Any shift finishing after 6.00 p.m. and at or before midnight
19.7.1(c) Day shift
Any shift which commences at 7.00 a.m. or later, but finishes at or before 6.00 p.m.
19.7.1(d) Night shift
Any shift finishing after midnight and at or before 8.00 a.m.
19.7.1(e) Continuous work
Work carried on with consecutive shifts throughout the 24 hours of each of the last six consecutive days without interruption, except during breakdowns, or meal breaks, or due to unavoidable causes beyond the control of the Company.
19.7.1(f) Rostered shift
A shift of which the employee has had at least 48 hours notice.
19.8 Ordinary hours - shift workers on continuous shifts
Continuous shift workers must work at such times as the Company requires, but:
19.8.1 subject to 19.4 and 19.7, a shift must be no longer than eight hours inclusive of meal time;
19.8.2 continuous shift workers must be allowed a 20 minute break in each shift for a meal, which must be counted as time worked.
19.9 One shift in 24 hours
Except at the regular changeover of shifts, an employee must not be required to work more than one shift in 24 hours.
19.10 Shift rosters
19.10.1 Shift work rosters must specify the starting and finishing times of ordinary working hours of shifts.
19.10.2 Employees must be given at least seven days' notice of any change to their shift work rosters. An exception to this is if the shift work roster has been varied by agreement between the Company and a majority of employees in the area concerned.
19.10.3 If any shift worker is required to change his or her roster, the employee must be given at least two days' notice of the change. If this notice is not given, the shift worker must be paid for the shifts worked during this period at the rate of double time. The employee may request that this notice be waived.
19.10.4 If an employee is required to transfer to another maintenance base with less than two days notice, and the transfer is for a period of more than two days, the employee is deemed to have changed his or her roster, and will be entitled to the payments prescribed under clause 19.10.3.
19.11 Shift loadings
Shift workers must be paid the following shift loadings:
19.11.1 For all shifts worked on a Saturday - time and a half;
19.11.2 For all shifts worked on a Sunday - double time;
19.11.3 For all shifts worked on public holidays, except Christmas Day and Good Friday - double time;
19.11.4 For all shifts worked on Christmas Day and Good Friday - double time and a half;
19.11.5 For all shifts worked between Sunday midnight and Friday midnight:
19.11.5(a) Early morning shift (commencing between 4.00 a.m. and 6.59 a.m.) - 15%;
19.11.5(b) Early morning shift (Mascot only, commencing at or before 5.59 a.m.) - 17.5%;
19.11.5(c) Early morning shift (commencing between midnight and 3.59 a.m.) - 22.5%;
19.11.5(d) Afternoon shift - 15%;
19.11.5(e) Night shift - 22.5%.

19.11.6 Employees who work afternoon and night shifts on weekends and public holidays will be entitled to an additional payment of $9.96 per shift.
19.11.7 Shift workers who work on afternoon or night shift work which does not continue for at least five successive afternoons or nights must be paid at the rate of time and a half.
19.12 Night shift loading
A shift worker who:
19.12.1 works night shift only during a period of engagement on shift work; or
19.12.2 remains on night shift for more than four consecutive weeks; or
19.12.3 works on a night shift which does not rotate with another shift or with day work so that the shift worker does not have at least one third of his or her working time off night shift in each roster cycle,
must be paid at the rate of single time plus a 30% loading for all time worked during ordinary working hours on night shifts.
19.13 Calculation of ordinary hourly rate
19.13.1 In this clause, the ordinary hourly rate of an employee will be obtained by dividing the employee’s annual salary by 1976 and adding the appropriate shift premium.
19.13.2 If an employee’s salary is in excess of the maximum of level 3, the employee’s ordinary hourly rate for calculating the shift premium will be obtained by dividing the maximum level 3 salary by 1976.

19.14 If:
19.14.1 an employee is classified in levels 5 to 7; and
19.14.2 the employee works in excess of the ordinary hours of work while working as a seven day continuous shift worker due to a requirement shown on the employee’s roster; and
19.14.3 the overtime is for the purpose of maintaining operational continuity,
the employee must be paid an allowance of $124.22 per month.
19.15 Transfer between systems of work
In order to meet the needs of the industry, an employee may be required to work as a day worker or as a shift worker, whether on continuous work or not, at the applicable rates. An employee may be required to transfer from one of those systems of work to another. If an employee is required to transfer between systems of work, the Company must give the employee at least seven day’s notice of the change.
