20. OVERTIME

20.1 Payment for working overtime - day work

All time worked outside ordinary hours must be paid for at the rate of time and a half for the first two hours and double time after that.

20.2 Payment for working overtime - shift work

For all time worked in excess of or outside the ordinary hours of work prescribed in this part, or on a shift other than a rostered shift, shift workers shall;

20.2.1 If employed on continuous shift work, be paid at the rate of double time; or

20.2.2 If employed on other than continuous shift work, be paid at the rate of double time except where the time worked is by arrangement between the officers themselves; or

20.2.3 If employed on other than continuous shift work, and required to continue work on his or her rostered day off, be paid at the rate of double time.

20.3 Calculation of overtime

20.3.1 In computing overtime each day’s work stands alone, except as provided for in 20.5.

20.3.2 In computing the number of hours worked per week any leave with pay must be treated as time worked.

20.3.3 Except in special circumstances no employee may work overtime unless properly authorised beforehand.

20.3.4 Except in unavoidable circumstances, all overtime worked during a pay period shall be paid for not later than the pay day for the next pay period.

20.4 Calculating overtime penalty rates

An employee’s annual salary must be divided by 1976 to obtain the employee’s ordinary hourly rate for the purposes of calculating overtime penalty rates. However, the maximum ordinary hourly rate must not exceed the rate obtained by dividing the maximum salary of level 3 by 1976.

20.5 Rest periods after overtime

20.5.1 Employees working overtime must have at least ten consecutive hours off duty between work on successive days.

20.5.2 If an employee does not have a ten hour break between periods of duty on successive days the employee must either:

20.5.2(a) be released after the completion of overtime until he or she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence; or

20.5.2(b) be paid at double time rates until he or she is released from duty and the employee is entitled to a ten hour break before resuming work without loss of pay for ordinary working time occurring during such absence.

20.6 Meal breaks

If an employee is required for overtime duty greater than one hour before the normal starting time, or after the usual finishing time, the employee must be:

20.6.1 granted a meal break of 30 minutes which must be paid at the appropriate overtime rate of pay. An employee of the Company may agree to vary this requirement to meet the circumstances but the Company will not be required to make any payment in respect of time allowed that is greater than 30 minutes; and

20.6.2 paid an allowance of $8.81 or supplied with a meal by the Company.

20.7 Recall to duty

20.7.1 If an employee is recalled to work overtime, whether notified before or after leaving the Company’s premises, the employee must be paid at the appropriate rate for a minimum of four hours work. If the employee works for more than four hours, the employee must be paid for the period actually worked. An employee is not required to work the full four hours if the work that is being undertaken is completed within a shorter period.

20.7.2 This subclause will not apply if overtime is continuous, subject to a meal break, with the completion or commencement of ordinary working time.

20.8 Transport

If an employee finishes work at a time when a reasonable means of transport is not available because the employee:

20.8.1 works overtime; or

20.8.2 works a shift which is not his or her rostered shift,

then the Company must provide the employee with transport, or pay the employee his or her ordinary salary for the time taken to travel home.

20.9 Exclusion

Employees on salaries greater than the maximum of level 4 who are required to work overtime are not entitled to the extra payments provided for in this clause, except for the meal allowance provided for in 20.6.

20.10 Time off in lieu of payment for overtime

20.10.1 An employee may elect, with the consent of the Company, to take time off in lieu of payment for overtime, at a time or times agreed with the Company, for the purposes of this clause.

20.10.2 Overtime taken as time off during ordinary time hours must be taken at the ordinary time rate.

20.10.3 The Company must, if requested by an employee, provide payment at the rate provided for the payment of overtime in the award for any overtime worked under this subclause, if such time has not been taken within four weeks of accrual.

20.11 Make-up time

An employee may elect, with the consent of the Company, to work make-up time under which the employee takes time off ordinary hours and works those hours at a later time, during the spread of ordinary hours provided for in the award, for the purposes of this clause.
