15. OVERTIME

15.1 All time worked in excess of ten hours per day will be regarded as overtime.

15.2 Except as provided in 15.3, overtime worked will be paid for at the rate of time and a half for the first three hours and double time thereafter.

15.3 An employee who works so much overtime between the termination of their ordinary work on one day and the commencement of their ordinary work on the next day that he has not had at least ten consecutive hours off duty between those times will, subject to this clause, be released after the completion of such overtime until he has had ten consecutive hours off duty without loss of pay for ordinary working times occurring during such absence. If on the instructions of the employer, such an employee resumes or continues work without having such ten consecutive hours off duty, he will be paid double rates until he is released from duty for such period and he will then be entitled to be absent until he has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.

15.4 Subject to 15.4.1 an employer may require an employee to work reasonable overtime at overtime rates.

15.4.1 An employee may refuse to work overtime, where the working of such overtime would result in the employee working hours which are unreasonable with regard to:

15.4.1(a) any risk to employee health and safety;

15.4.1(b) the employees personal circumstances including any family responsibilities;

15.4.1(c) the needs of the workplace or enterprise;

15.4.1(d) the notice (if any) given by the employer of the overtime and by the employee of his or her intention to refuse it; and

15.4.1(e) any other relevant matter.
