Under section 289 of the Fair Work Act 2009, the Fair Work Commission is required to publish all submissions made to annual wage reviews.
Submissions to the Annual Wage Review 2021–22 will be published on this website when received.
However, if a submission made by a person or body includes information that is claimed to be confidential or commercially sensitive, and the Commission is satisfied that the information is confidential or commercially sensitive, the Commission:
- may decide not to publish the information, and
- may instead publish:
- a summary of the information which contains sufficient detail to allow a reasonable understanding of the substance of the information (without disclosing anything that is confidential or commercially sensitive), or
- if the Commission considers that it is not practicable to prepare a summary that would comply with the subparagraph above – a statement that confidential or commercially sensitive information in the submission has not been published.
