Minimum standards order and decision made

An Expert Panel of the Fair Work Commission has made the Interim On-Demand Delivery Employee-like Worker Minimum Standards Order.

The order covers employee-like workers who are engaged through an application (app) and mainly do on-demand delivery of ‘consumables’ (food, beverages, liquor) or supermarket groceries. It also covers the digital labour platform operators that engage them.

The order includes terms about:

  • minimum hourly rates
  • vehicles
  • consultation
  • records
  • fines
  • insurance
  • dispute resolution
  • right to (unpaid) time away
  • information sharing
  • delegates rights
  • a gig worker information statement. 

The minimum standards order has been made following public consultation. Minor amendments have been made to the draft that was published on 8 July 2026. The changes include a different name and an updated start date of 17 August 2026.

The order will be reviewed if a notice of intent and draft order is issued in either of two related cases (MS2024/1 or MS2024/2).
