Who can use this form
Use Form F95 if you are lodging this declaration with Form F94 – Application to register a collective agreement.
This declaration must be completed together by:
- the regulated business, and
- the registered organisation (like a union)
covered by the collective agreement.
Before you start
Have this information ready before you start.
You will need tell us:
- basic details of the collective agreement, such as its name and the class of regulated workers it covers
- details of the negotiating entities
- details of the persons making the declaration on behalf of the negotiating entities
- steps taken to explain the collective agreement to the regulated workers covered by the collective agreement
- whether the notice under Section 536MN(1)(a) or Section 536MN(1)(b) of the Fair Work Act was given to the regulated workers covered by the collective agreement
- whether there are any minimum standards orders in operation that cover the same regulated workers as the collective agreement
- how the terms of those minimum standards orders (if any) compare to the terms of the collective agreement.

What happens next
We will undertake an assessment of the collective agreement on the information and material provided.
We will also publish a copy of this declaration on our website if your collective agreement is registered in accordance with Section 536MS(4) of the Fair Work Act.
