Fair Work Australia proposed to vary clause 42 - Wages in Part 9 - Bulk Terminal Operations of the Sugar Industry Award 2010 pursuant to section 160(2)(a) of the Fair Work Act 2009, to remove ambiguity or uncertainty or correct error.
Pursuant to para 243 of the Full Bench decision issued on 4 September 2009 [[2009] AIRCFB 826] at the time of making the modern award, the rate for Classification BT1 in clause 42.1 should have been fixed at the entry level rate applying in other modern awards.
