Animations to support you in unfair dismissal cases

We have produced 2 new animations to better support employers and employees in unfair dismissal cases. The animations provide you with information about the 21-day time-limit, late applications, and extension of time. 

The aim of the animations is to inform and prompt action from our users where relevant. This may be to access more information, apply on time, or consider whether to raise a jurisdictional objection. This will better support our users to understand the implications of making an out of time application and increase lodgements made within time.

Access to simple, clear and targeted information is crucial to providing access to justice. As a justice institution, the information we need to communicate can be complex in nature. This complexity can create barriers for some users in accessing our services. It is critical that we provide you with the information you need, at the right time and in the right format.

Our commitment to improving access through the ongoing digital transformation of our services is unwavering. Over the past few years, we have used modern best practice to transform our information. Techniques including plain language, behavioural insights and user experience design are now embedded in the transformation of our case management practices and information resources. 

This website, our plain language correspondence, online forms, the Modern Awards Pay Database and online learning platform are recent examples of our approach.  We know we can do more, and we continue to explore ways to improve how we deliver information to meet the diverse needs of the Australian community.

The aim is to prompt action. Whether that be applying on time, or considering an objection, we hope they help you.

  1. 21-day time limit in unfair dismissal cases

    This animation explains the 21-day time limit in unfair dismissal cases. Remember, the clock starts on the day after the dismissal takes effect. Public holidays and weekends count towards the time limit. However, if the 21st day falls on a weekend or public holiday, you may lodge the following business day.   2. Late applications in unfair dismissal cases

    This animation explains that late applications are generally not accepted. We consider these applications 'out of time'. People can ask for an extension of time. However, a Commission Member will only grant an extension of time in exceptional circumstances. Employers or respondents to the case can also raise an objection. See unfair dismissal for more information.
