An employer needs to check if its pre-2010 agreement still covers any of its employees. If it does, the employer must give the employees a written notice.
If your pre-2010 agreement no longer covers anyone, you don’t have to do anything.
If a pre-2010 agreement still covers one or more employees (it is a ‘zombie agreement’), the employer must give the employee(s) a written notice about the sunsetting of the agreement.
